1. Who we are

TINYtutor (the "Service") is operated by Ellen Gayle Schwinger("we", "us", "our"). By creating an account, accessing, or using the Service you ("you", "user") agree to be bound by these Terms of Service ("Terms").

2. Acceptance

Continued use of the Service constitutes acceptance of these Terms and our Privacy Notice. If you do not agree, do not use the Service. If you are using TINYtutor on behalf of a child, you confirm you are the child's parent or legal guardian and have authority to accept these Terms on their behalf.

3. The Service

TINYtutor provides structured-literacy practice activities, including phonics lessons, leveled readers, fluency passages, a dyslexia-aware screener, and progress monitoring. The Service is an educational supplement and is not a diagnostic tool or a substitute for evaluation or instruction by a licensed professional.

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

All software, content, lessons, passages, designs, and branding that make up the Service are owned by Ellen Gayle Schwinger or her licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or household educational purposes during your active subscription.

7. Payments, subscriptions, and refunds

Paid plans are processed by our payment provider, Shopify. By purchasing, you also agree to the applicable Shopify checkout terms. Subscriptions renew on the cadence shown at checkout until you cancel. Refunds are handled under our Refund Policy.

8. Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

You agree to indemnify and hold us harmless from any claim arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

We may suspend or terminate your access at any time for: (a) material breach of these Terms, (b) non-payment, (c) suspected fraud, abuse, or security risk, or (d) repeated or serious violations of our policies. On termination your right to use the Service ends; sections that by their nature should survive (IP, liability, indemnity, governing law) will survive.

We may modify these Terms or the Service from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, notified by email. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of competent jurisdiction in that state.
